Regulation 16 Consultation 24th February – 8th April 2016

Totnes Community Development Society (TCDS) as a qualifying body has prepared a draft Community Right to Build Order for Atmos Totnes, The Former Totnes Creameries Site, Totnes, TQ9 5JP for and with the local community.

 

Where can I see plans for Atmos Totnes?

Following submission of the draft Community Right to Build Order by Totnes Community Development Society to South Hams District Council they are now presenting the draft Order as a six weeks consultation, as per Regulation 16 of the Neighbourhood Planning Regulations 2012.

Please note: South Hams District Council is presenting the material for Regulation 16 consultation therefore Totnes Community Development Society cannot accept direct comments on this Consultation.

 

What representations should be made at this point?

Comments and objections on any aspect of the proposals are welcome. Representations at this stage should also address whether or not the draft Community Right to Build Order meets the basic conditions and other matters that an independent examiner is required to consider under paragraph 8 of Schedule 4B to the Town and Country Planning Act 1990 (as amended). The Basic Conditions are that Totnes Community Development Society Community Right to Build Order for Atmos Totnes must:

  • have appropriate regard to national policies and advice contained in the National Planning Policy Framework (NPPF);
  • contribute to the achievement of sustainable development;
  • be in general conformity with the strategic policies contained in the Local Plan for the area; and
  • be compatible with EU obligations, including human rights requirements.

 

What happens next?

Following the end of the consultation, comments will be assessed and fed back into the ongoing design process led by Totnes Community Development Society. Objections to the plans will be reported and responded to. Depending on the modifications required, Totnes Community Development Society and South Hams District Council would aim to submit the Community Right to Build Order to an Independent Examiner who assess the Order against the Basic Conditions: including checking if planning policy has been dealt with appropriately as well as ensuring the consultation has been carried out in the correct way. If recommended by the Independent Examiner, the Order can proceed to a referendum, either with or without modification.
